1. shapeshifters is a collaborative online tool for creatives worldwide operated by shapeshifters information management ltd. (limited liability company under the laws of austria, shortly shapeshifters ltd.). shapeshifters ltd. allows anyone with an internet connection and www browser to use the shapeshifters online service and place content, e.g. information, pictures, links, documents, etc. (the "content") on shapeshifters. By using shapeshifters.net you will contribute to a new kind of meeting place for creatives based on the values of mutual appreciation and global respect. By sharing information with like-minded people who consider entrepreneurial risk-taking as important as social responsibility your use of shapeshifters.net will foster economic relations recognizing cultural diversity as a highly valued asset.
2. please take any steps necessary to ascertain that the content you publish on shapeshifters is correct, verified, and does not infringe third parties´ rights. the user is solely responsible for the use of shapeshifters, their activity therein and for any damage that arises from such use. by posting content on shapeshifters you are granting permission to shapeshifters ltd. and other users of shapeshifters to access the content within shapeshifters. the risk of any modification or loss of content lies with the user.
the user declares and guarantees being solely entitled to the content placed by him/her on shapeshifters, that the user holds any and all rights hereto, in particular copyrights and that the posting of the content on shapeshifters and its use therein does not violate any laws or third-parties rights. in the event any third party or public authority raises a claim against shapeshifters ltd. (in or out of court) for or in connection with the usage of the content on the site, the respective user will indemnify and hold harmless shapeshifters ltd., in particular pay in advance any legal fees or retainers demanded by attorneys.
3. shapeshifters ltd. respects the privacy of its users and commits to protect it. shapeshifters ltd. collects personal related data, namely your name, address, profession, only if you as a user actively make this data available to shapeshifters ltd., and information regarding the users' usage of the shapeshifters online service (users´ IP address, referring URL, access time, browser type, etc). shapeshifters ltd. needs this data in order to identify you when visiting our web page. the users´ data will only be used for the purposes for which you made them available to shapeshifters ltd. and for the purpose of surveying and analysing the users´ online behaviour on shapeshifters; for these purposes the data may be transmitted to third parties being affiliated to shapeshifters ltd. or instructed by shapeshifters ltd. to handle the data. unless required by law, we will not share our users' personal information, IP-addresses and user information, except in aggregate or anonymous form, with any other third parties. however, due to our offered services, we cannot guarantee that the data will only be made available to countries having the same data protection level as guaranteed within the european union. therefore, you specifically consent to the transfer of your data to countries not having the same level of protection as the european union.
in order to optimise the services of shapeshifters ltd., shapeshifters operates so-called session cookies. only if you allow cookies in your browser setting, shapeshifters will use cookies for the length of the connection and afterwards the cookies will be deleted. please be informed that if you do not allow cookies, shapeshifters ltd. cannot provide the services in the same manner.
according to various data protection provisions, you may instruct shapeshifters ltd. to delete your data at any time. please submit a written request to the following address:

4. shapeshifters, shapeshifters ltd. logo and shapeshifters ltd. design are registered or unregistered trademarks of shapeshifters ltd. and may not be commercially used without prior express written permission of shapeshifters ltd. website design, content originating from shapeshifters ltd., data compilation and databases are intellectual property of shapeshifters ltd. protected by the austrian copyright act and international copyright agreements worldwide. as far as shapeshifters is based on OSS the respective GPL applies with its terms regarding the rights to works not derived from the OSS. apart from the provisions in the OSS GPL, no reproduction, distribution or making available of any of these works is permissible without prior written permission from shapeshifters ltd. user-posted content may be copyrighted, and any use of such content must be authorised by the respective user.
5. nothing found on shapeshifters has necessarily been reviewed by professionals with expertise required to provide you with complete, accurate and reliable information. user-posted content does not represent advice, opinions or belief of shapeshifters ltd. shapeshifters ltd. allows the users to set links to third-parties websites, which links are not under shapeshifters ltd. control and shapeshifters ltd. is not responsible for the content of any linked website or any link contained in the linked website.
6. shapeshifters ltd. does not guarantee that the content found on shapeshifters is correct, complete, reliable or valid. shapeshifters ltd. does not guarantee that the content does not violate any laws, in particular intellectual property, unfair competition, press or criminal laws or good morals. under no circumstances shall shapeshifters ltd. be liable for any indirect, direct, consequential or punitive damages of any kind and any other damages whatsoever including loss of profits.
shapeshifters ltd. is entitled, but in no way obliged, to verify the content. shapeshifters ltd. is entitled to remove any content without any prior notice that, for example, is suspected of violating any laws and ethics of the site. in any such event, shapeshifters ltd. is also entitled to suspend the respective user from the online service. any liability for the removal of content/suspension of user is excluded. any violation of this agreement will resolve in the termination of your shapeshifters account. shapeshifters ltd. reserve the right to refuse service to anyone for any reason and any time without any liability.
7. if you believe that content on shapeshifters infringes third-parties right, in particular copyright, please send a notice to office@shapeshifters.net, indicating that you are the right holder or authorized by the right holder, indicating the work that is claimed to be infringing, the infringing work, contact information of the right holder to notify, including address, telephone number and email-address, statement that the notifier and the right holder has good faith to believe that the material is not authorized by the right holder and a statement made under penalty of perjury that the information provided is accurate.
8. we reserve the right to modify or terminate the shapeshifters online service for any reason, without prior notice at any time. we reserve the right to alter these terms of use at any time, which will be notified to you on shapeshifters or via email. If you wish to deregister, send an email to office@shapeshifters.net.
9. the relationship between shapeshifters ltd. and the user shall be exclusively governed by and construed in accordance with the laws of austria, without giving effect to the choice of law provisions thereof. any claim, dispute or controversy arising out of or related to this relationship, or breach thereof, and any matter arising therefrom, shall be exclusively resolved by the competent court in vienna, austria.
