General Terms & Conditions

1. Each Global Reality Check (Synthesis) contains insights from global correspondents on a given question provided by the client. Each Global Reality Check (Synthesis) delivers a five (5) page report in English language and is provided to the client as a digital document along with three (3) paper printouts if requested. Please contact us directly for the terms and conditions that apply to the Global Reality Check (Fact Finding Mission).
2. The opinions and statements expressed in a Global Reality Check (Synthesis) represent the personal opinions, insights and experiences of at least fifteen (15) individual correspondents, their local networks, and those of lead researcher Sanjay Khanna. Correspondent-provided content does not necessarily represent the opinions and beliefs of Shapeshifters.
3. The content of the standard Global Reality Check (Synthesis) is based on 15 correspondents located on all five world continents. The client can expand the research to a greater number of correspondents, focus a Reality Check to certain geographical areas, and ask for in-depth reports on certain research findings - in which case special terms and conditions apply.
4. The client will get information about the professional background of each correspondent involved but has no rights to obtain personal contact data.
5. Shapeshifters reserves the right to refuse certain inquiry questions for any reason.
6. Shapeshifters will only disclose that amount of information to its correspondent network that has been approved in writing by the client in the project briefing.
7. Each Global Reality Check (Synthesis) consists of the following five (5) steps:
   • Defining the perfect question
     Shapeshifters helps the client to refine one precise research question that will go out to the Shapeshifters’ Global Correspondent Network.
   • Signing of the briefing
     This question becomes part of the client one-page briefing, which the client signs off to authorize Shapeshifters to commence work on the work product.
   • Global outreach
     Fifteen (15) correspondents, who are exclusively chosen by the Global Reality Shapeshifters_Global Reality Check_Terms and Conditions_20081021_ep.doc 2 Check lead researcher, are given a maximum
   • Making meaning
     Sanjay Khanna as the lead researcher synthesizes the correspondent's feedback for a final five (5) page report in English language.
   • Presentation
     The Global Reality Check Synthesis is provided to the client for review. During a one-hour follow-up phone session, Sanjay Khanna reviews the Global Reality Check Synthesis with the client as part of a conversation. At this point, the job is complete.
8. If you believe that content within a given Global Reality Check (Synthesis) violates thirdparty rights, in particular copyright, please send a notice to sanjay.khanna@shapeshifters.net, indicating that you are the rights holder or authorized by the rights holder, indicating the work that is claimed to be infringing, the infringing work, contact information of the rights holder to notify, including address, telephone number, and email-address, stating that the notifier and the rights holder do in good faith believe that the material is not authorized by the rights holder and a statement made under penalty of perjury that the information provided is accurate. Shapeshifters is not responsible for the content of third-party websites in case we provide links in a Synthesis.
9. Under no circumstances shall Shapeshifters be liable for any direct, indirect, consequential or punitive damages of any kind and any other damages whatsoever, including loss of profits based on information given in a Global Reality Check (Synthesis).
10. We reserve the right to modify or terminate Shapeshifters Global Reality Checks for any reason, without prior notice at any time. We reserve the right to alter these terms of service at any time, and we will notify you of such alterations via email.
11. The relationship between Shapeshifters and clients shall be exclusively governed by and construed in accordance with the laws of Austria, without giving effect to the choice of law provisions thereof. Any claim, dispute or controversy arising out of or related to this relationship, or breach thereof, and any matter arising therefrom, shall be exclusively resolved by the competent court in Vienna, Austria.
